These Terms & Conditions (“Terms”) govern your access to and use of myAutomatedAgent.ai (“myAutomatedAgent,” “we,” “us,” or “our”), including our website, software platform, artificial intelligence features, CRM, automation, communications, and related services.
By creating an account, purchasing a subscription, or using our services, you agree to these Terms.
1. ELIGIBILITY AND ACCOUNTS
You must be legally capable of entering into a binding agreement to use our services.
You are responsible for maintaining accurate account information, protecting your login credentials, and all activity occurring through your account and authorized users.
You may not share access beyond the number of users permitted by your subscription plan.
2. SERVICES
myAutomatedAgent.ai provides software and technology designed to assist real estate professionals with functions that may include CRM, lead management, automated follow-up, artificial intelligence, voice and text communications, email, scheduling, marketing, websites, workflows, and related business activities.
Features may change, improve, be added, or be discontinued over time.
3. ARTIFICIAL INTELLIGENCE AND AUTOMATION
The platform may use artificial intelligence and automated systems to generate content, communicate with leads or customers, qualify inquiries, schedule appointments, summarize information, and perform other tasks.
AI-generated information may be incomplete, inaccurate, or inappropriate for a particular situation.
You are responsible for reviewing and supervising your use of AI and automated features and for ensuring that communications and activities conducted through your account comply with applicable laws, regulations, industry requirements, and professional obligations.
myAutomatedAgent.ai does not provide legal, financial, tax, real estate brokerage, or other professional advice.
4. CUSTOMER RESPONSIBILITIES
You are responsible for the information, contacts, leads, content, campaigns, phone numbers, email addresses, integrations, and other materials used through your account.
You are responsible for obtaining all permissions and consents required to contact individuals through telephone calls, SMS, email, artificial intelligence, automated systems, or other communication methods.
You agree not to use the platform for unlawful, deceptive, fraudulent, abusive, harassing, discriminatory, or unauthorized purposes.
5. MESSAGING AND COMMUNICATION COMPLIANCE
You are responsible for complying with laws and regulations applicable to your communications, including consent, opt-out, identification, calling-time, and recordkeeping requirements.
Recipients must be provided with legally required methods to opt out of communications.
You may not use myAutomatedAgent.ai to send spam or communications to individuals when you do not have the required permission or lawful basis to contact them.
6. SUBSCRIPTIONS AND BILLING
Paid services are billed according to the subscription plan selected at checkout.
Subscriptions automatically renew for the applicable billing period unless canceled before the next renewal date.
You authorize us and our payment providers to charge the payment method associated with your account for subscription fees and other authorized charges.
Except where required by law or expressly stated otherwise, payments already made are non-refundable.
7. USAGE-BASED CHARGES
Certain services may involve usage-based charges in addition to the subscription price. These may include telephone calls, SMS/MMS messaging, artificial intelligence usage, email services, premium workflow actions, or other consumption-based services.
Applicable usage charges may vary based on the services used and underlying provider costs.
You are responsible for charges generated through your account and authorized users.
8. PLAN LIMITS
Subscription plans may include limits on users, features, capacity, usage, or other resources.
If your needs exceed the limits of your current plan, you may be required to upgrade to an appropriate plan.
9. CANCELLATION
You may cancel your subscription in accordance with the cancellation options provided through your account or by contacting support.
Cancellation prevents future subscription renewals but does not automatically refund amounts previously paid unless required by law.
Access to paid services may continue through the end of the applicable paid billing period.
10. THIRD-PARTY SERVICES
myAutomatedAgent.ai relies on and may integrate with third-party providers for services such as communications, artificial intelligence, payment processing, hosting, CRM infrastructure, analytics, and other functionality.
Third-party services may experience outages, interruptions, changes, or limitations outside our control.
Your use of certain integrations may also be subject to the third party's terms and policies.
11. DATA AND PRIVACY
Our collection and handling of personal information is described in our Privacy Policy.
You retain responsibility for data that you or your authorized users upload, collect, import, or process through your account and for ensuring you have the legal right to use that information.
12. INTELLECTUAL PROPERTY
The myAutomatedAgent.ai platform, branding, software, designs, systems, documentation, and related materials are owned by or licensed to us and are protected by applicable intellectual property laws.
These Terms provide you with a limited, non-exclusive, non-transferable right to use the services during an active subscription. They do not transfer ownership of our intellectual property to you.
You retain ownership of content you lawfully provide through the platform.
13. PROHIBITED USE
You may not:
• Use the services for unlawful purposes.
• Attempt to gain unauthorized access to systems or accounts.
• Interfere with or disrupt platform security or operation.
• Use the platform to distribute malware or harmful content.
• Misrepresent your identity or authorization.
• Send unlawful spam or unauthorized communications.
• Copy, reverse engineer, resell, or exploit the platform except as expressly authorized.
• Use the services in a manner that violates another person's rights.
14. SERVICE AVAILABILITY
We work to maintain reliable services but do not guarantee uninterrupted or error-free operation.
Maintenance, third-party outages, telecommunications failures, internet disruptions, software errors, security events, or circumstances outside our reasonable control may temporarily affect availability.
15. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by law, the services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
We do not guarantee specific leads, appointments, transactions, revenue, commissions, business results, or outcomes from using the platform.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, myAutomatedAgent.ai and its owners, affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the services.
To the maximum extent permitted by applicable law, our aggregate liability for claims arising from the services will not exceed the amount you paid to us for the services during the six months immediately preceding the event giving rise to the claim.
Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.
17. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless myAutomatedAgent.ai and its owners, affiliates, officers, employees, contractors, and service providers from claims, damages, losses, liabilities, and reasonable expenses arising from your unlawful use of the services, your content or data, your communications, or your violation of these Terms.
18. SUSPENSION OR TERMINATION
We may suspend or terminate access when reasonably necessary to address nonpayment, fraud, security risks, unlawful activity, abuse, material violations of these Terms, or risks to the platform or other users.
19. CHANGES TO THESE TERMS
We may update these Terms periodically. Updated Terms will be posted with a revised “Last Updated” date.
Continued use of the services after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.
20. GOVERNING LAW
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
